OVERVIEW
Welcome to Bonhaga! The terms “we”, “us” and “our” refer to Bonhaga ApS (“Bonhaga”). Bonhaga operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”).
Our online store is hosted on Shopify Inc., a third-party e-commerce platform based in Canada. Shopify provides the technical infrastructure for our online store, but is not a party to any sales contract between you and Bonhaga. All sales, deliveries, and customer service obligations rest solely with Bonhaga in accordance with Danish and EU law.
These Terms of Service (the “Terms”) together with our Privacy Policy describe your rights and responsibilities when using our Services.
By visiting or making a purchase through our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use our Services.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms, you represent that you are at least 18 years old or otherwise of legal age in your country of residence. You agree to provide accurate and complete information when creating an account or making a purchase and to maintain the confidentiality of your account credentials.
You are solely responsible for all activity under your account. You may not assign or transfer your account to any other person.
SECTION 2 - OUR PRODUCTS
We strive to present our products as accurately as possible. However, please note that colors and textures may appear differently depending on your device and settings.
Minor variations between images and actual products may occur.
Nothing in this section limits your statutory rights under the Danish Sale of Goods Act (Købeloven), including your right to remedies for defective goods and a two-year warranty period (reklamationsret).
SECTION 3 - ORDERS
When you place an order, you make an offer to purchase the products. Bonhaga reserves the right to accept or decline your order. Your order is accepted when we send an order confirmation email.
If you are a consumer residing in the EU, you have a 14-day right of withdrawal (fortrydelsesret) from the date you receive your goods, subject to the exceptions stated in our Refund Policy. To exercise this right, please follow the instructions in our Refund Policy.
Once your order has been dispatched, it cannot be cancelled except as allowed by law or by our return policy.
You represent that your purchases are for personal or household use only and not for resale.
SECTION 4 - PRICES AND BILLING
All prices are shown in USD and include applicable Danish VAT (moms) unless otherwise stated. Prices, discounts, and promotions are subject to change without notice.
You agree to provide current and accurate payment information and authorize us to charge your chosen payment method for your order.
If you reside outside the EU, United States or any of the other markets that we fulfil orders from, additional customs duties or import taxes may apply, which you are responsible for paying.
SECTION 5 - SHIPPING AND DELIVERY
Estimated delivery times are provided for convenience and are not guaranteed. We are not responsible for delays caused by carriers, customs, or circumstances beyond our control.
In accordance with EU Directive 2011/83/EU, risk of loss passes to you only once you or someone you designate has taken physical possession of the goods.
SECTION 6 - INTELLECTUAL PROPERTY
All content on the Services — including text, graphics, logos, images, and layout — is the property of Bonhaga, its affiliates or licensors, and is protected under Danish and EU intellectual property law.
You may access the Services for personal, non-commercial use only. Any reproduction or distribution without written consent is prohibited.
SECTION 7 - OPTIONAL TOOLS
You may be provided with access to tools offered by third parties. These are provided “as is” and “as available” without warranties or liability. Your use of any third-party tools is at your own risk and subject to their own terms.
SECTION 8 - THIRD-PARTY LINKS
The Services may include links to third-party websites. We are not responsible for the content or operation of such websites. Please review their policies before engaging in any transactions.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
Bonhaga is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Bonhaga. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Bonhaga, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Bonhaga.
SECTION 10 - PRIVACY POLICY
Your personal data is processed in accordance with the EU General Data Protection Regulation (GDPR) and the Danish Data Protection Act (Databeskyttelsesloven).
Our store is hosted by Shopify, which acts as our data processor under GDPR. Personal data may be transferred outside the EU/EEA in accordance with appropriate safeguards.
You have the right to access, correct, delete, or restrict processing of your personal data, and to lodge a complaint with Datatilsynet (the Danish Data Protection Agency).

SECTION 11 - FEEDBACK
If you submit feedback, reviews, or suggestions (“Feedback”), you grant us a non-exclusive, royalty-free license to use it for business purposes. You represent that you have the right to submit such Feedback and that it does not infringe third-party rights.
SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information that contains typographical or pricing errors. We reserve the right to correct any such errors and update information without notice, provided that this does not affect your statutory rights.
SECTION 13 - PROHIBITED USES
You may use the Services only for lawful purposes. You may not misuse the Services, transmit malicious code, or infringe the rights of others. We reserve the right to suspend or terminate access for any misuse.
SECTION 14 - TERMINATION
We may suspend or terminate your access if you violate these Terms. Provisions that by nature should survive termination will continue to apply.
SECTION 15 - DISCLAIMER OF WARRANTIES
The Services are provided “as is” for general informational and retail purposes.
However, nothing in these Terms limits your statutory rights under Danish or EU law. Products are covered by a two-year warranty under the Danish Sale of Goods Act.
SECTION 16 - LIMITATION OF LIABILITY
We are liable only for damages caused by intent or gross negligence and for personal injury or loss where required by mandatory Danish law.
In consumer contracts, we are liable in accordance with Danish law, but we are not responsible for business losses or indirect damages such as loss of profit unless caused intentionally or by gross negligence.
SECTION 17 - INDEMNIFICATION
You agree to indemnify Bonhaga and Shopify against claims arising from your misuse of the Services, except where such claims arise due to our negligence or breach of duty. This does not limit your statutory consumer rights.
SECTION 18 - SEVERABILITY
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect to the fullest extent permitted by law.
SECTION 19 - WAIVER; ENTIRE AGREEMENT
Failure to enforce any provision shall not constitute a waiver. These Terms and our policies constitute the entire agreement between you and Bonhaga regarding your use of the Services.
SECTION 20 - ASSIGNMENT
You may not assign these Terms without our written consent. We may assign or transfer our rights and obligations without notice.
SECTION 21 - GOVERNING LAW
These Terms and any related disputes shall be governed by Danish law.
Disputes shall be brought before the City Court of Copenhagen (Københavns Byret) unless otherwise required by mandatory law.
Bonhaga is the contracting party for all sales and services. Shopify acts solely as a platform provider and data processor under GDPR.
SECTION 22 - HEADINGS
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
SECTION 23 - CHANGES TO TERMS OF SERVICE
We may update these Terms from time to time. Material changes will be communicated in accordance with Danish consumer protection law. Continued use of the Services after updates constitutes acceptance.
